The Chief Justice of the Islamabad High Court (IHC) noted that the relevant Commissioner of Inland Revenue (IR) at Zone-I Regional Tax Office (RTO), Islamabad, did not provide adequate legal assistance regarding the show cause notice issued to a well-known private school in Islamabad.

The Chief Justice of the Islamabad High Court (IHC) has instructed the Chief Commissioner of Inland Revenue at the Regional Tax Office (RTO), Islamabad, to appear before the court at the next hearing regarding Roots Millennium Schools Pvt Ltd.

In relation to this matter, the Chief Justice of the Islamabad High Court (IHC) has issued directives to the Chairman of FBR for immediate compliance with the court’s order.

As per the Chief Justice’s directive, the Commissioner of Inland Revenue (IR) for Zone appeared in person under the court’s order but could not provide legal assistance on the issue in question. The Chief Commissioner of Inland Revenue concerned is required to appear in person at the next hearing. A copy of this order shall also be sent to the Chairman of FBR, as per the Chief Justice’s instruction

A prominent private school in Islamabad has filed a constitutional petition against the show cause notice issued by the FBR.

Whether the show cause notice is based on incorrect and unlawful information, violating sections 81 to 84 read with section 172 of the Income Tax Ordinance, and therefore should be declared legally invalid and struck down accordingly?
